DISTANCE SALES CONTRACT

Identity No: Address: Phone: E-mail: Hereinafter, the SELLER and the BUYER will be collectively referred to as the “Parties.”

2. SUBJECT OF THE CONTRACT 2.1. The subject of this contract is to define the mutual rights and obligations of the Parties under the provisions of the Consumer Protection Law No. 6502 (the “Law”) and the Regulation on Distance Contracts regarding the performance of the service that the BUYER has requested electronically through https://www.yonneti.com (the “Website”), owned by Yıldız Berk Eğitim Bil. Tek. Araç. İth. İhr. Tic. Ltd. Şti., whose specifications and sales price are specified below. 2.2. This Contract has been drawn up in accordance with the Law on the Protection of Consumers No. 6502, the Regulation on Distance Contracts, and other relevant legislation. The BUYER and the SELLER, who are the parties to this Contract, declare and undertake that they are informed about their responsibilities and obligations assigned to them by this Contract, the law and regulations to which the Contract is subject, and other relevant legislation. 2.3. The BUYER acknowledges and declares that they have been informed electronically about all preliminary information regarding the service subject to sale, including the SELLER’s name, title, full address, phone number, other contact information, the basic features of the service being sold, the sales price including taxes, payment methods, and costs, the right of withdrawal, how to use the right of withdrawal, and how to submit complaints and objections, and that they have confirmed these preliminary details electronically and subsequently placed an order for the service in accordance with this contract. 2.4. The preliminary information on the SELLER's website and the invoice issued based on the order placed by the BUYER are integral parts of this contract.

3. SERVICE CONDITIONS 3.1. Type of Service and Payment Method Service Name: Sales Price (Including VAT) Online Consulting Session for Visa Services: 4000 TL/Hour Service Recipient(s): 3.2. The payment for the service promised by the SELLER under this contract will be made by the BUYER through a credit card on the SELLER's website at the time of booking a consultation appointment, and the transaction will be completed online. 3.3. The BUYER and the invoice details may belong to the same or different persons. In case they are different, the BUYER is solely responsible for the accuracy of all information provided. The BUYER must ensure that the information they provide to Yıldız Berk Eğitim is complete and accurate. Yıldız Berk Eğitim will not be held responsible for any damages arising from incomplete, inaccurate, or mismatched information provided by the BUYER. 3.4. The service will be considered performed once the BUYER schedules an appointment for visa services on Yıldız Berk Eğitim’s website, makes the payment, and Yıldız Berk Eğitim agrees to provide the service at the scheduled appointment time. If the payment is not made or if there are insufficient funds on the BUYER's credit card, the appointment will not be confirmed, and no service will be provided. The BUYER accepts and declares that the appointment will only be confirmed once the payment is successfully processed, and the SELLER will not be obligated to provide any service if the payment is not received. 3.5. If the information provided by the BUYER for the appointment is found to be inaccurate, Yıldız Berk Eğitim reserves the right to cancel the service. 3.6. The BUYER may change or cancel their appointment once, provided they notify the SELLER at least 12 (twelve) hours in advance. If the BUYER cancels their appointment at least 12 (twelve) hours before the appointment time, they will receive a full refund. If the BUYER does not attend the appointment without providing notice or contact Yıldız Berk Eğitim, no refund will be given. If less than 12 (twelve) hours remain until the appointment, the BUYER does not have the right to cancel or request a refund. 3.7. In the event of force majeure, which prevents or delays the performance of this Contract, the affected Party must notify the other Party within 6 (six) hours of the occurrence. Otherwise, the affected Party will not be able to claim damages. In the case of force majeure that makes it impossible for the SELLER to provide the service, such as natural disasters, war, fire, government actions, and unforeseen circumstances beyond the control of the SELLER, the SELLER agrees to notify the BUYER and postpone the service appointment or issue a refund if necessary.

4. CONTRACT DATE AND VALIDITY This Contract becomes effective once the BUYER approves it electronically and completes the payment for the appointment made on the website. It will terminate once the service has been rendered or when the appointment is canceled at least 12 (twelve) hours before the scheduled time.

5. BUYER'S DECLARATIONS AND OBLIGATIONS

6. 5.1. By confirming this Contract and the Preliminary Information Form electronically, the BUYER acknowledges and declares that they have been informed by the SELLER about the SELLER’s title, full address, phone number, and other contact details, the basic features of the service subject to sale, the price of the service including taxes, payment methods and costs, the right of withdrawal, how to exercise the right of withdrawal, official bodies where complaints and objections can be submitted, and all rights and obligations arising from the contract, in a clear and understandable manner, in compliance with the relevant provisions of the Law No. 6502 on the Protection of Consumers. The BUYER also acknowledges that they have read, understood, and agreed to all the terms of this Contract without any objections.

7. 5.2. The BUYER acknowledges and declares that they have been informed by Yıldız Berk Eğitim about the right to cancel or change the appointment once, provided that they notify at least 12 (twelve) hours in advance, and that they will not be entitled to any refund or changes if they fail to meet this notice requirement. The BUYER agrees that they will receive a full refund if they cancel the appointment at least 12 (twelve) hours before the scheduled time. However, the BUYER agrees and declares that they will not be entitled to any refund if the cancellation is made less than 12 (twelve) hours before the scheduled time.

8. 5.3. The BUYER consents to the sharing of their personal data with third parties, as required for the performance of the appointment and in compliance with the relevant legal and administrative regulations.

9. 5.4. The BUYER may not transfer or assign their rights under this Contract or their appointment to third parties.

10. 6. SELLER'S DECLARATIONS AND OBLIGATIONS

11. 6.1. Yıldız Berk Eğitim agrees and undertakes to perform its obligations under the Consumer Protection Legislation, except in cases of force majeure.

12. 6.2. Yıldız Berk Eğitim cannot be held responsible for any damages arising from system errors that prevent the provision of appointment services on its website https://www.yonneti.com.

13. 6.3. The payment for the service under the Contract will be credited to Yıldız Berk Eğitim’s account after the BUYER makes the appointment request and completes the credit card payment through the website. The service is deemed completed once Yıldız Berk Eğitim provides the requested appointment time and date to the BUYER.

14. 6.4. In cases where it becomes impossible to perform the service due to unforeseen circumstances, the BUYER will be informed within 6 (six) hours, and the total amount paid will be refunded to the BUYER within 14 (fourteen) days, resulting in the termination of the Contract. In such cases, the BUYER agrees and declares that they will not claim any additional compensation for material or moral damages from Yıldız Berk Eğitim.

15. 7. RIGHT OF WITHDRAWAL

16. The BUYER may exercise the right to withdraw from the Contract without incurring any legal or criminal liability and without providing any justification, provided they notify the SELLER at least 12 (twelve) hours before the appointment time. In such cases, the BUYER will receive a full refund of the amount paid. Once the specified withdrawal period has expired, the BUYER will no longer be able to claim the appointment fee under the right of withdrawal. The costs associated with the exercise of the right of withdrawal will be borne by the SELLER. By accepting this Contract, the BUYER acknowledges that they have been informed about the right of withdrawal in advance.

17. 8. DEFAULT AND CONSEQUENCES

18. In the event that the BUYER defaults on payments made by credit card, they will be responsible for paying interest to the issuing bank under the credit card agreement. In such cases, the issuing bank may pursue legal remedies, demand the collection of legal costs and attorney fees from the BUYER, and, in any event, if the BUYER defaults on their debt, the BUYER agrees to compensate the SELLER for any damages and losses resulting from the delayed payment.

19. 9. OBLIGATIONS REGARDING THE PROTECTION OF PERSONAL DATA

20. 9.1. The BUYER is obliged to provide the necessary personal data in full and accurately as requested by the system to schedule an appointment. The BUYER is solely responsible for the consequences of any incomplete, incorrect, or outdated data, and Yıldız Berk Eğitim cannot be held responsible for any related issues.

21. 9.2. Yıldız Berk Eğitim takes appropriate administrative, legal, and technical measures in its system infrastructure to ensure the security of the information and transactions provided by the BUYER, in accordance with technical capabilities. However, the BUYER is responsible for taking necessary precautions on their own device to ensure data security, including against viruses or other harmful applications.

22. 9.3. The term “Personal Data” as used in this contract refers to information that can be used to identify the BUYER, including but not limited to name, surname, date of birth, nationality, passport number, passport expiry date, T.C. identity number, travel start and end dates, landline and mobile phone numbers, email address, residential or business address, account information, billing address, and purpose of travel. Yıldız Berk Eğitim reserves the right to request additional information due to the requirements of embassies or consulates of relevant countries.

23. 9.4. Yıldız Berk Eğitim is not responsible for verifying the accuracy of the personal data provided by the BUYER. The BUYER is fully responsible for ensuring the accuracy, completeness, and correctness of the personal data they provide.

24. 9.5. Except for legal obligations, Yıldız Berk Eğitim will only process personal data for the purposes of booking appointments and providing consultancy services. The BUYER consents to the processing of their personal data for these purposes.

25. 9.6. The BUYER acknowledges and declares that they consent to the collection, storage, and processing of their personal data as necessary for the duration required to achieve the purpose of processing, and for sharing it with relevant units where necessary.

26. 9.7. The BUYER has the right to access, request deletion, and request modification or update of their personal data at any time. Personal data will be stored for the duration of the visa application process or longer if required by law.

27. 9.8. Personal data will not be shared, disclosed, or made available to third parties except as specified in this document. However, personal data may be shared with relevant units, business partners, suppliers, employees, or third parties as required for the provision of the consultancy services. In addition, personal data may be disclosed to third parties as required by law, court orders, or decisions from public institutions.

28. 9.9. Yıldız Berk Eğitim takes reasonable precautions to ensure that personal data is accurate and up-to-date. The BUYER may request corrections, updates, or deletions of their personal data related to travel dates, email addresses, or phone numbers if they cancel their application.

29. 9.10. Yıldız Berk Eğitim uses industry-standard security measures, including firewalls and data protection protocols, to safeguard personal data collected online. However, Yıldız Berk Eğitim cannot guarantee absolute security against individuals attempting to bypass internet security measures. Therefore, the BUYER acknowledges and accepts that Yıldız Berk Eğitim is not liable for any such breaches and that no claims can be made against Yıldız Berk Eğitim in this regard.

30. 9.11. By entering the required data into the system and completing the online transaction to book an appointment, the BUYER acknowledges that they understand and consent to Yıldız Berk Eğitim’s data collection, usage, and disclosure practices, and agrees that Yıldız Berk Eğitim cannot be held responsible for any claims arising from the use, storage, and processing of their data.

31. 9.12. The BUYER acknowledges that their personal data will be completely deleted once the purpose for processing the data has been fulfilled or after the legal retention period has expired.

32. 10. COMPETENT COURT

33. In the event of disputes arising from the implementation of this contract, the Consumer Arbitration Committees and Consumer Courts located at the BUYER’s or Yıldız Berk Eğitim’s residence shall be competent up to the monetary limits announced annually by the Ministry of Industry and Trade in December.

34. The BUYER acknowledges and declares that they have been informed about the SELLER’s title, full address, phone number, the basic features of the service subject to sale, the sales price including taxes, payment methods, the fact that the service in question is an exception to the right of withdrawal, official bodies where complaints and objections can be submitted, and all rights and obligations arising from the contract, and that they have confirmed this information electronically, subsequently placing an order for the service, and they have no objections to this Contract.

35. The Preliminary Information Form, Distance Sales Contract, and the invoice issued based on the order placed by the BUYER on the website https://www.yonneti.com are integral parts of this Contract.
